These terms are an agreement between you and KyraForm ("we", "us") for the use of the KyraForm website and service. By creating an account or using the service you accept them. If you use KyraForm for an organisation, you confirm you may accept these terms on its behalf.
1. The service
KyraForm lets you build online forms, share them, collect and manage responses, collect payments through your own payment gateway, run approval workflows and send responses to other tools. Features vary by plan, as described on our pricing page.
2. Your account
- You must be at least 18 years old and give accurate information.
- Keep your password safe. You are responsible for activity under your account.
- Tell us straight away at hello@kyraform.com if you think your account has been misused.
3. Your forms and the people who fill them in
You own your forms and the responses they collect. You give us permission to store, process and display them only as needed to provide the service to you.
When you collect personal data with KyraForm, you are responsible for collecting it lawfully. That includes telling respondents who you are and why you are collecting their data, getting any consent the law requires, and honouring their requests. You agree that we process responses on your behalf under our privacy policy.
4. Acceptable use
You must not use KyraForm to:
- collect passwords, one-time codes, full card numbers or other credentials, or impersonate another person or organisation (phishing);
- send spam, or collect data you have no right to collect;
- distribute malware, or attack, probe or overload the service or other systems;
- publish content that is unlawful, defamatory, hateful, sexually explicit involving minors, or that infringes someone else's rights;
- collect payments for illegal goods or services, or for anything your payment gateway prohibits;
- resell or reverse engineer the service, except where the law allows it.
We may remove content or suspend accounts that break these rules, and will tell you why unless the law or the risk of harm prevents us.
5. Plans and payment
- The Free plan is free with the limits shown on the pricing page. We may change those limits with 30 days' notice.
- Pro and Ultra are paid in advance, monthly or yearly, and start when the first payment succeeds. There is no free trial of paid plans; the Free plan has no time limit.
- Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
- Paid plans are billed in US dollars. Applicable taxes, such as GST or VAT, are added at checkout. Prices may change with at least 30 days' notice before your next billing date.
- If a payment fails, we will tell you and retry. If it still fails after 14 days, your organisation moves to the Free plan.
- Cancellations and refunds are covered by our cancellation and refund policy.
- On-Prem licences are governed by a separate written agreement.
6. Payments you collect on your forms
Payments made on your forms go through your own account with Razorpay, Stripe, PayPal, PayU, Paytm, BillDesk or another supported gateway. That gateway's terms govern those payments. KyraForm is not a party to them, does not hold the funds, and does not handle refunds or disputes between you and the people who pay you.
7. Availability and changes
We work to keep KyraForm available and secure, but it is provided without a guaranteed uptime unless a written agreement says otherwise. We may improve, change or retire features; if we remove a significant paid feature, we will give you reasonable notice.
8. Ending the agreement
You can close your account at any time. We may suspend or close it if you seriously or repeatedly break these terms, or if the law requires it. After closure you have 30 days to export your data; after that it is deleted as described in our privacy policy.
9. Intellectual property
The service, its software and the KyraForm name and logo belong to us. These terms do not give you any right to them other than to use the service. If you send us feedback, we may use it without obligation to you.
10. Disclaimers
Except as expressly stated in these terms, the service is provided "as is". AI features can make mistakes; review AI-generated forms before you publish them.
11. Liability
To the extent the law allows, we are not liable for indirect or consequential losses, or for loss of profits, revenue or data. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
12. Indemnity
You will compensate us for claims made against us by third parties arising from your forms, the data you collect, or your breach of these terms.
13. Law and disputes
These terms are governed by the laws of India. The courts at Chennai, Tamil Nadu have exclusive jurisdiction, subject to any consumer protection rights you have where you live.
14. Changes to these terms
We will post updates here. For significant changes we will email account owners at least 30 days before they take effect. Continuing to use KyraForm after that means you accept the new terms.
